I acknowledge the Tour de Menlo is an athletic event that is an extreme test of a person’s physical and mental abilities and carries with it the potential for property loss, serious injury and even death. The risks include, but are not limited, to those caused by or due to a medical condition, lack of training, inattention, negligence or carelessness on the part of myself; due to defective equipment; due to bicycle, pedestrian and automobile traffic; due to roadway conditions, terrain, weather; and due to negligent or intentional actions of third persons, including other participants, volunteers, spectators, event officials and monitors, and/or producers of the event. Understanding the above, I hereby expressly and implicitly assume all of the risks of participating in this event.
I certify that I am physically fit, I will wear a helmet during the ride that satisfies the US DOT or U. S. Consumer Product Safety Commission standards for bicycle helmets, I have adequately trained to participate in the event, and I have not been advised not to participate in this event by a qualified medical practitioner. I acknowledge that this Accident Waiver and Release of Liability Form will be relied upon by the event holders, sponsors and organizers of the event and that it will govern my actions and responsibilities at said event.
In consideration of my application to participate in this event, I hereby expressly agree to: (1) Waive and release the Rotary Club of Menlo Park Foundation and the Rotary Club of Menlo Park, including their directors, officers, members, agents, representatives, and sponsors (“Releasees” herein), from any liability and claims I may have due to losses or injuries which I may sustain while participating in this event; (2) Indemnify and hold harmless the Releasees from any and all liability, loss, cost, attorney fees, or damages arising out of claims made by third parties due to my negligent or intentional actions; and (3) consent to receive emergency medical treatment that may be deemed advisable and necessary in the event of injury, accident and/or illness during this event.
I understand that during this event I may be photographed and videotaped. I consent to allow the Releasees to publish any photograph or videotape of me for purposes of documenting or publicizing the event. This Accident Waiver and Release of Liability shall be construed broadly to the maximum extent permissible under law.
PARENT/GUARDIAN WAIVER FOR MINORS (Under 18 years old)
I am the parent and/or guardian of (name of the minor participant). I hereby represent and confirm that the minor is physically fit to participate in the Tour de Menlo. I have read and understand the above Accident Waiver and Release of Liability Form, and in consideration for allowing the minor to participate, I consent to the above form and agree that its terms shall likewise bind me, the minor, my heirs, legal representatives and assignees, and on behalf of the minor I hereby expressly and implicitly assume all of the risks of the minor participating in this event. I further consent to photographs or videotapes which may be taken of the minor during this event to be published by the Releasees for the purposes of documenting or publicizing the event. I represent that I am acting as the parent and/or legal guardian of the minor and agree to save and hold harmless and indemnify each and all the Releasees referred to above from all liability, loss, cost, attorney fees, claim or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.
